1 Acceptance of Terms

By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. These Terms apply to all visitors, registered users, retailers, distributors, and super distributors.

2 Eligibility

To use our services, you must:

• Be at least 18 years of age.
• Be legally competent to enter into a binding contract under the Indian Contract Act, 1872.
• Possess a valid mobile number, email address, and the KYC documents required for your role.
• Not be barred from using our services under any applicable law.

3 Account Registration

When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access.

One person may not maintain more than one account of the same role without prior written permission. Duplicate or fraudulent accounts may be suspended without refund.

4 Services Provided

Our platform offers digital services including, but not limited to:

• Mobile and DTH recharges.
• BBPS bill payments (electricity, water, gas, broadband, insurance).
• PAN card services (NSDL ePAN, UTI PAN, PPAN, etc.).
• AEPS / Aadhaar-enabled banking services.
• Money transfer and UPI collection.
• API integrations for partners and businesses.

Services are provided through third-party operators, banks, and payment gateways. Availability, charges, and processing time may vary based on the partner.

5 Payments & Wallet

You must maintain sufficient balance in your wallet to use the services. Wallet top-ups are made through supported payment methods. You agree that:

• Wallet balance is non-transferable and cannot be encashed except through the official withdrawal process.
• All payments are subject to verification and fraud checks.
• You will not use the platform for any unlawful fund transfers or money-laundering.
• Any charges, taxes, or service fees applicable will be deducted as per the current pricing.

6 Commission & Payouts

Commission rates are determined by your assigned plan (Retailer / Distributor / Super Distributor). Commission is credited to your wallet upon successful completion of eligible transactions.

• Commission rates may be revised by us at any time with prior notice on the platform.
• Failed or reversed transactions do not earn commission.
• Distributors and Super Distributors may earn multi-level commission on their downline's eligible transactions.
• Withdrawal requests are processed as per our settlement schedule and subject to minimum balance requirements.

7 Prohibited Activities

You agree not to:

• Use the platform for any illegal, fraudulent, or unauthorized purpose.
• Provide false KYC information or impersonate another person.
• Attempt to hack, reverse-engineer, or interfere with our systems or APIs.
• Abuse chargebacks, refunds, or promotional offers.
• Resell or sublicense our services without written authorization.
• Violate any applicable laws, including anti-money-laundering (AML) and RBI guidelines.

8 KYC & Compliance

To access full services, you must complete KYC verification as required by the Reserve Bank of India and other regulators. Failure to complete KYC may result in limited access to certain services or suspension of your account.

9 Limitation of Liability

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim any warranties, express or implied. We are not liable for:

• Failures, delays, or errors caused by third-party operators, banks, or payment gateways.
• Losses arising from unauthorized use of your account due to your negligence.
• Indirect, incidental, or consequential damages.
• Any loss of profit or business opportunity.

Our total liability for any claim shall not exceed the amount paid by you for the affected transaction.

10 Suspension & Termination

We reserve the right to suspend, restrict, or terminate your account without prior notice if we detect suspicious activity, breach of these Terms, or a legal/regulatory requirement. Upon termination, your wallet balance (if any) will be settled as per our refund policy after deducting outstanding dues.

11 Intellectual Property

All content on this platform — including logos, trademarks, software, API documentation, and design — is the property of E-Kendra or its licensors. You may not copy, modify, distribute, or reproduce any part without written permission.

12 Dispute Resolution

These Terms are governed by the laws of India. In case of any dispute, both parties shall first attempt to resolve it amicably through our support team. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts in the jurisdiction of our registered office.

13 Changes to Terms

We may update these Terms from time to time to reflect changes in law, regulation, or our services. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the platform after such changes constitutes your acceptance of the new Terms.
